§ 24. Sale of certain property.

  • The town council shall have the right to buy, sell and/or exchange any part of the public domain including public streets which are not considered necessary or convenient for public use when such sale is deemed by the council in its uncontrolled discretion to be for the best advantage and interest of the town and its inhabitants; but the town shall not close, exchange or sell any public street or part of streets which has been opened to the public by the municipality and used by the public at any time during three years next prior to the time of consideration of such sale except after approval by a majority vote of those voting in a referendum election held for the purpose of determination of the subject of such proposed sale.
